This document sets forth Privacy Policy of the Mobile App – “In Real Life” (“IRL”) provided by Emoto Labs, LLC (“we” or “us”). Emoto Labs, LLC is committed to protecting Users’ (“your”) privacy. This Privacy Policy applies to the Mobile App and governs data collection and usage. This Privacy Policy, together with our Terms and Conditions, provides an explanation as to what happens to any personal data that you provide to us, or that we collect from you. By using the Mobile App, you consent to the data practices described in this policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.

COLLECTION OF YOUR PERSONAL INFORMATION

 

IRL App collects personally identifiable information (“Personal Information and other information as requested or required”), such as your E-mail address, Name, User Name, mobile number, date of birth, photo, gender, religion, ethnicity, payment details when you register for our service/create an account and access IRL app, any personal information shared during the recording of videos, and other information as required/requested. These details are handled through our secure servers and will be securely stored. Emoto Labs, LLC also collects anonymous demographic information, which is not unique to you, such as your Postal code and Country.

There is also information about your mobile hardware and software that is automatically collected by Emoto Labs, LLC. This information is used by IRL App to deliver personalized service, to maintain quality of the service, and to provide general statistics regarding the use of IRL App.

IRL App is not meant for use of persons below 18 years of age. If you are under 18 years of age, then please do not use the App or access our Website at any time or in any manner. If Emoto Labs, LLC, learns that you are below 18 years of age, your account will be cancelled.

USE OF GOOGLE ANALYTICS AND COOKIES

 

We use Google Analytics to collect information. Google Analytics are cookies used to collect information about how visitors use our App. We use the information to compile reports and to help us improve our App services. IRL App may use cookies to gather information about your App use. Where used, these cookies are downloaded to your phone automatically. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your Mobile. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. IRL App uses “cookies” to help you personalize your online experience.

One of the primary purposes of cookies is to provide a convenience feature to save your time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize IRL App features, or register with IRL App services, a cookie helps IRL App to recall your specific information on subsequent visits. This simplifies the process of recording your personal information. When you return to the same IRL App feature, the information you previously provided can be retrieved, so you can easily use the IRL App features that you customized.

USER SUBMISSIONS

 

IRL App allows users to upload their own videos, as well as those of others (all of the above is referred to as “User Submissions”). You affirm, represent, and/or warrant that you own or have the necessary licenses, rights, written consents, release and/or permissions of every identifiable individual to use the submissions made by you. As a user, you understand and accept that you are solely responsible for your own User Submissions and the consequences of posting or publishing them. Emoto Labs, LLC will in no way be responsible or liable for any User Submission. Users shall not upload any videos depicting sex, violence, drugs or those which are abusive. Emoto Labs, LLC reserves the right to report such User Submissions to authorities concerned or where it is mandated to report such content. The information you enter is stored on a server and available to other users. By posting, uploading, inputting, providing or submitting information, you are granting Emoto Labs, LLC, its affiliated companies, necessary sublicenses, permission to use your submission in connection with the operation of their businesses.  

 

USE OF YOUR PERSONAL INFORMATION

 

Emoto Labs, LLC uses personal information provided by you at the time of registering/opening the account, for use of IRL and/or other projects or its partner projects, to operate, maintain and provide to you the features and functionality of IRL App. We use this information to provide you better access to the service. Your personal information can be used by other users to view your profile and contact you. By providing your email address and phone number, you agree to our contacting you to send you communications/ SMS regarding new features/services offered and to remind you to use the App.

Emoto Labs, LLC does not sell, rent, lease or disclose its user lists or personally identifiable information to third parties otherwise than as stated in this Privacy policy. We may share data with our trusted partners who help us perform statistical analysis, send you email or postal mail, provide customer support.

When you subscribe to our mailing list, Emoto Labs, LLC may use it for email/SMS marketing, but we protect the users’ information and make sure it is secure. All third parties whose services are used by Emoto Labs, LLC are prohibited from using your personal information except to provide their services to Emoto Labs, LLC, and they are required to maintain the confidentiality of your information.

NON – PERSONAL INFORMATION

 

We may share non-personally identifiable information like anonymous usage data, features used, etc. with interested third parties to help them understand the usage patterns for some of our services.

DISCLOSING YOUR INFORMATION

 

Emoto Labs, LLC will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Emoto Labs, LLC, IRL App or the site; (b) protect and defend the rights or property of Emoto Labs, LLC; and, (c) act under exigent circumstances to protect the personal safety of users of IRL App, or the public.

SECURITY OF YOUR PERSONAL INFORMATION

 

All personal information collected is secured by encryption. Emoto Labs, LLC may transfer your personal information that you submit or IRL App collects from you, to its servers for processing and storing. By submitting your personal data, you agree to this transfer, storing or processing. Emoto Labs, LLC will take all reasonable steps to make sure that your data is treated securely without any loss, misuse or alteration of information and in agreement with this Privacy Policy.

While you can terminate your account at any time, your information may remain stored in archive on our servers even after the deletion or termination of your account. However, we will not sell, transfer, or use the information relating to the terminated account of an individual in any way.

The transmission of information via the internet is not completely secure and therefore Emoto Labs, LLC cannot guarantee the security of data sent to us electronically and transmission of such data is therefore entirely at your own risk.

CHANGES TO THIS POLICY AND OPT-OUT

 

Emoto Labs, LLC will occasionally update this Privacy Policy to reflect company and customer feedback. We may notify you by posting a prominent announcement on our web pages/App. However, Emoto Labs, LLC encourages you to periodically review this Policy to be informed of how Emoto Labs, LLC is protecting your information.

In case of business transition, if we sell our business, the customer information will be a part of the business sold. You will be notified via email and/or prominent notice on our Website for 30 days of any such change in ownership or control of your personal information. If you are not happy with the Privacy Policy of the new owner, you may stop using the service and notify not to use your personal information and de-activate/terminate your account.
